I will definitely send all these letters today or tomorrow. But why are we not sending to all the service centers? Why only Texas? There are many cases at Vermont, California service centers which were never transferred to Texas. Would it not be appropriate to include these service centers in this campaign?

There is a difference between laws and regulations. Laws are what in INA (Immigration and Naturalization Act) and Regulations are what in CFR.
It takes congress and senate to change laws where as it takes discretion to change regulations. And the good news is that discretion can be challenged.
There is another thread on the issue and some of us think that we do have a case. Initial response from a certain lawyer has been positive.

The affected parties (i.e. us) need to show damage in certain way and I do have some points that can be used. Our primary point is that the spirit of law has not been upheld.
Following are the steps in making this a reality:
a) Gather around 50 people
b) Develop and finalize draft of the case. Rolling_Flood has a initial draft.
c) Hold initial consultation with a lawyer.
d) Decide as a team if we want to continue.
e) File a class action suit
Not sure what is the total cost but given the years of wait and uncertainty $500 per person should be reasonable. I will also create a yahoo group to start these discussions.
Notes:
If you already have applied in EB2 you won't be affected.
If you have a Masters you won't be affected.

Do you know how much time it will take to get that status change? What if your PD is no longer current?
Yes it is a concern that I have to address. However I see 2 ways to work around it.
1. Travel out of country get H4 stamping done based on my current H1B status
or
2. I apply for I-485 and add my wife later to the application when we have received her H4. In this case, once I have applied, I can add my wife to the application even if the dates are not current at that time.

Its good that its rescheduled. We again have a chance.

Its just sad that when it comes to processing immigration applications, we are too many. But when it comes to contributions or calling senators and sending emails, WE ARE TOO FEW :confused:

Guys, I received a "Processing Complete" email from the consulate this morning (Jan 9th). My interview at the Mumbai consulate was on Dec 28th. I submitted my PP to the VFS and should have it back in a couple of days. Good luck to everyone and thank you for all the posts!

both H1 were approved from the same USCIS center? the one which is stuck in PIMS, which service center it was?

We need to track the H1b approval date and the service center that approved it.
For those who don't know, the first three letters of the receipt number in you I-797 H-1b approval notice indicates the service center.
Like SRC is Texas, EAC is Vermont, LIN is nebraska and CSC for california.
Please include this info too.

I have sent an email to CISOmbudsman.Publicaffairs@dhs.gov and they responded with the following email content.

I did not send G-28 even though I have an attorney. I think that part is only if you want them to respond to your attorney rather than yourself.

Your reasoning is weak. If the same Goldman manager wants to screw you - he won't see if it is recession or not - he will screw you - period.
What happens with ICE and goldman is an issue they sort it out. If his budget is tight - he will figure out a way.
As far as jobs are concerned - there is no gaurantee that the best and brightest is always in jobs or those who suck up always have jobs - YOU are responsible on how you choose and carve your career

Most companies now taking projects that can give them local resources only (H1B/L1B/GC/EAD/USC etc. but physically prsent). Look at utilization percentage in offshore companies. So if they say, I only require GC/USC and not H1/L1, there is no way you would be able to challenge them. I can deal with things on a level playing ground and I don't have "suck it up" attitude.
This GC/USC alone job ads will be lot safe for them if you guys go on a mass scale. If they can't find a guy, most companies now a days are putting off projects and wait. So your campaign on this scale will not help H1Bs at all.
Don't think you will always get what you see.. This is a web and pulling just one string is not possible.

yes if you are filing another 485 with your spose as primary and you as dependent..
you need to fill out A#'s assigned with first applications..
if both r filed on the same day ....then there is no way u can mention each other on application...
my lawyer said if if it is filed like that ...u can combine the two applications when u get the receipts...

i dont think the country makes a big difference, i have two friends stuck in name check (one was born in canada with an english first and last name). i think its the combination of the name, DOB and a crappy system

All right, looks like we got (or will get) some attention from media. DOS and USCIS got (or will) it too. That's good. They will forward flowers to hospital, and this is good too (hate to waste flowers)! Bad, if they will not strip messages from buckets, veterans do not need them at all, BUT if they decided to take messages off ... just picture that USCIS will stuck on forwarding flowers instead of doing their job. Have a questions for the Gurus...Is Credit Check performed during any of the processes related to FBI (for people who are present in the US with a SSN) ? IF so, will a Foreclosure in the credit check cause any problems or delays in adjudicating the 485 petition ?
