    THe reason USCIS is showing low numbers for the reason that , no one will then raise the question for recpature. Looking at the numbers they will say, O, the numbers are so low, whats the need for recapture and we will be left hanging cold and dry.

    This is a plot of a well planned strategy.

    So the question araise is why the dates are not moving or not current?

    I received I-485 approval letter from USCIS today which reads as follows:

    "The above application has been approved. Prior to receiving your permanent resident card you may be required to report for biometrics processing (photo/fingerprint/signature). Please do not take any action at this time. If you are required to report for this processing, you will receive another notice advising you of the date, time and location to appear.

    If you have not received your permanent resident card or the above mentioned notice to appear for biometrics processing within 90 days, please call this office at the number listed above."

    Did anyone receive a notice like this? How many days did it take to get the biometric notice after this notice if anyone received the above?

    My wife already received her physical green card although she is beneficary of my application.

    I was planning on going to India in Nov, but can't book now as I don't know how long it will take :mad:

    I don't think InfoPass will entertain me to request for Biometrics especially since this notice tells to wait.

    Anyone with similar notice, any inputs are greatly appreciated. Thank you friends!!

    Create your account & you can file your self with out lawyer's assistance. It's always suggested to file EAD(I-765) & AP(I-131) jointly. You can pay by credit card.

    (2) Now a days USCIS will set up an apointment for BIO-2 of EAD.
    (3) You have to send supportive documents for Advance Parole, like photos,brief explanation of qualifying for AP...I can give you those sample formats !

    Coming to I-485 BIOMETRICS, call USCIS & ask them about BIO. Go to this website & register https://egov.immigration.gov/cris/jsps/index.jsp. You must add I-485,EAD,AP & I-140 receipt numbers like LINXXXX and you will get emails when they get approved. You can also see the changes on 'LAST UPDATED' column, which means your case is touched by an officer. But it's not the confirmation of approval until status message has changed or you got an email.

    Go thru these 2 links & familiarize well. Hope your I-140 has approved. Finally these are suggestions only & I am not a lawyer. Consult an immigration lawyer if you have uncanny issues.

    1) My I 140 was approved
    2) I just got my Bio appointment and i am all set with that. i received 1 week after the appointment date but we just walked in and got Bio with out any problem.
    3) MY EAD is the only problem
    As i mentioned it has been almost 2 years and its still pending. i gave my biometrics at that time and i received my AP for me and my husband. My husband (dependent) got ead but not me :confused:

    I called the Nogales (mexico) US embassy and they were able to look up the PIMS system using the petition number.

    I hope the PIMS is a "centralized" system. So even the consulate in India would be using the same.

    Best of Luck.

    Before you file the law suit consider this,

    The system is designed to get GC faster to the smarter (EB1, EB2, EB3 etc) or the rich (Investor). Sometimes circumstances decide in which queue you start the journey, Employer, attorney, how many days left in h1b etc, etc, etc

    I do not like to jump queues and resent people who jump queues. But these are the people who look for opportunities and exploit them. These are the smart ones.

    System favors people who are skilled (higher the better), By finding (new Labor, new I140) and using an opportunity these people have proved that they are worthy of the faster queue (eb3 to eb2, eb2 to eb1 etc).

    What is wrong in rewarding the hardworking smart person with the original PD. After all that PD was established for that person(thank god LC sub is gone). That is the day an employer decided to sponsor GC for that person.

    I know you are asking
    �What about me, I was working hard in the University (MS/PhD)?�
    Your reward is you get to start the journey in EB2, 1 year+ in EAD and 6 years in H1. If you are really smart you would have got your employer to apply for GC with at least 5 years left on your H1 clock.

    The system is designed to create conflict.

    Having to exit the freeway to change lanes does not make sense to me.

    Your reasoning is weak. If the same Goldman manager wants to screw you - he won't see if it is recession or not - he will screw you - period.

    What happens with ICE and goldman is an issue they sort it out. If his budget is tight - he will figure out a way.

    As far as jobs are concerned - there is no gaurantee that the best and brightest is always in jobs or those who suck up always have jobs - YOU are responsible on how you choose and carve your career

    I agree to all the law abiding people here... But be just a word of caution, it can bite you back.

    Now a days we are seeing lot of protentionism not from laws, but from hiring managers. Most companies now taking projects that can give them local resources only (H1B/L1B/GC/EAD/USC etc. but physically prsent). Look at utilization percentage in offshore companies. So if they say, I only require GC/USC and not H1/L1, there is no way you would be able to challenge them. I can deal with things on a level playing ground and I don't have "suck it up" attitude.

    This GC/USC alone job ads will be lot safe for them if you guys go on a mass scale. If they can't find a guy, most companies now a days are putting off projects and wait. So your campaign on this scale will not help H1Bs at all.

    Don't think you will always get what you see.. This is a web and pulling just one string is not possible.

    I've been current since July, 2010 and got RFE on Sept 10, 2010. I don't have letter with me as yet to know about RFE.

    Before REF, I waited for few weeks then tried followings:
    1) Took infopass : Officer sent email to expedite.
    2) Wrote to Senator: got reply they would get reply in 60-90 days
    3) Sent an email via attorney to TSC: got automated response.

    Then I got RFE after about 2-3 weeks of these attempts.

    Before I begin with my question, allow me to give you a brief overview of my case:
    In the year 2000, I initially filed for Labor Certification.
    In 2004, I received approval of my application for Employment Authorization (I-765).
    In 2005, I was sent a letter from the USCIS indicating that my application was rejected because I failed to file my case prior to a certain date issued by the USCIS.

    Pretty straight-forward, right? Wrong. You see, in the last letter I was sent by the USCIS it states that I failed to file my case promptly enough; I filed my case nearly a year before the deadline was set!
    My lawyers and I have attempted to appeal the decision, however our attempt has been futile: our request for appeal has been denied.

    I am unsure of what to do now... It is apparent that the USCIS messed up, but I cannot think of any way to reopen my case and prove it. My attorney has presented me with two options - in mid-June he will engage in a conference call with a senior individual at the Immigration Office, at which time he will present cases (including mine) which have been wrongfully denied; my second option is to sue the United States.
    I am very unsure of what course of action to pursue now! My lawyer has kept my waiting all this time with stalls and meetings which he has stated will help my case, however with each passing meeting, it simply seems like he is giving me false hope... I really do not want to have to wait until mid-June, only to find out that I must wait even longer before my case is reopened.
    Additionally, I am highly reluctant to sue the United States of America for messing up in the processing of my case. The judge presiding over my case will be a United States citizen - it would be like telling a child to kill his/her parent... it simply cannot happen! If I were to sue the United States of America, I would be fighting an uphill battle and risk deportation if I were to lose.

    Please! Has anyone on here been rendered an unfavorable decision by the USCIS based on a mistake made by the Immigration office? What have you done to fix your case?
    Attorneys: have any of your clients been put into this situation? What have you done to resolve the issue?

    Everyone: I understand that a very small percentage of people are likely to be in the same boat that I am in, however regardless of whether or not you are in this situation, what would you do if you were in my shoes???
    Would you sue the government and risk deportation? Would you wait endlessly, hoping that things become better, eventually? Or would you do something else? (If so, what?)

    If you are offended, I don't give a DAMN!! I know about India very well and has been to India many a times. I know very well about the indian corruption which has no comparison with any country in the developed world. All you have to look at is the suveys from various NGOs that track corruptiy on at various countries in the world and you can see where India ranks relative to US or UK

    1. We all agree there are loopholes in each and every system. Are you trying to fill 1% by punishing 99% of the people. If you want to fix loopholes this is not the right place to be. Go to the court and fight with the adminstration. Why the hell you are wasting your time.
    2. Considering you are a anti-immigrant, and you want to fix the system. Are you targeting Employment based immigrants or family based immigrants. Employement based immigrants are just 17% of the total immigrants whereas family based immigrants are more than 50+ %. better target them. Don't waste your time since you won't get anything as everybody over here are working and US employers want them.
    3. If you are unemployed, please spend your time in findiing a job. The minimum salary in US is around 8 dollars a hour so you have wasted your entire day. close to 100 dollars. You have not earned a thing by writing your thoughts in this forum.
    4. Senator Grassley and Durbin are working on your side and they also like you don't want a google, yahoo, ebay and other firms to suceed iin US. Be prepare to immigrate to some other country in future.

    Thanks Appas.. I sent an email to ombudsman on tueday and got a response on wednesday with the message. I also attached DS701 form, copy of I140 approved notice, I485 receipt notice.

    I recieved nothing. I cant check whether my check is cashed or not as my lawyer asked for draft and not personal check. Dont know whats going on...cant talk to the lawyer as the company doesn't allow....Man this is too frustrating...

    any way to get a duplicate/copy??

    you might be able to get a duplicate by contacting the college/university.

    my case is somewhat similar, but I dont have that option: I was on L2-EAD and I cannot find that damn EAD card (needed for filing EAD based on I485). However I do have the older I-797 so can atleast prove status...
