If you entered on AP and your I485 is pending, you cannot fell out-of-status as you are being considered in "Adjustment of status" status. This is somehow a special kind of a status. The only problem one may have is if the I-485 is denied for any reason. At that point you fell out of status. That's the reason many choose to enter on h1 instead AP. Then, even if I485 is denied, a person who entered on H1 is still in H1 legal status. Hence, it is generally advisable to enter and maintain an non-immigrant status while i485 is pending.

I dont expect USCIS to get all emotional because of our flowers and issue an update to their updated bulletin saying they will now accept and issue green cards.
The point is that we need to make awareness that there is a HUGE community that gets affected by every move they make and that we are an active and cohesive community and also to create awareness of this debacle.
Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. What Pappu says is right. Ppl have been so impatient that they're bombarding USCIS with SRs, emails, letters from attorneys, Infopass etc..etc...etc...I understand the anxiety but isnt this a bit 2 much? I was no exception to this. I raised an SR on the very first day my date got current and on trying to followup on the SR the very next week, I stumbled upon a clearly tired second level IO who didn't like the way I was pushing for it. He clearly explained to me that there was no need to worry as the dates were current and everyone who was current and cleared of security would be approved as there were several visa numbers available and he also told me that there have been thousands of calls received everyday and its becoming really hard for them to handle the situation. I could see how tired and frustrated he was. I immediately understood their plight and just waited without any further action and within a span of 15 days after that call, I got my approval. My attorney also advised me to wait as he was sure the dates were gonna be current the next month as well and followups would only result in delays.
Well I'm not saying its wrong to be anxious. Ofcourse, its an important milestone, one that secures our future in this country and yes, its only natural to be anxious. But being anxious doesn't mean that by calling or emailing or Ombudsman etc...ur case will be approved. Try and put yourselves in the IO's shoes as well. For a moment think what it wud be like to be an USCIS first lvl/second lvl IO receiving the same call every minute from a diff person and each one trying to reach the second lvl IO with lies such as my A# on file is diff than the one on 140 OR address change etc...etc...This is ridiculous. After years of wait we resort to such shameful behavior towards the end.
Yes when others with later PDs are getting approved and u r still waiting, it does bring out frustration in u. But u should also put in thought as to why that could be. Maybe one of the security checks in ur case is awaited or maybe ur file is on some table waiting to be picked up etc...I was venting out my anger and frustration during my wait on this forum and ppl were only asking me to do that, do this blah blah blah. I just waited nevertheless as I knew the moment I spoke with the IO that there was really no point in following up as cases were getting approved and USCIS was definitely WORKING as hard as they could (even on weekends) to clear all current cases.

Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.

The L1 visas done by the outsourcing companies are the main reason for the employment problem. These companies like TCS, Wipro etc.. bring people in L1A, L1B blamket visas to do the common development/Business Analysis/Project Management job in the client site.
There is no quota for L1 Visas. They can bring any # of people they want. Per law the L1A s should be of senior managerial position with at least 4 subordinates working under them in US and L1B should be of specific skill very important for the project and not available in US. But the most of the L1As from these companies are just programmers/BAsor small PMs. They are directly controlled by their client manager.
The main intent of these our sourcing companies is to send the employees on L1 and the employees are constantly told to somehow transfer the project to offshore.

Either employers think EAD is the student EAD which needs to be converted to H1 or they are ignorant.
My suggestion would be to not bring it up....and if it does come up tell the employer that you have work authorization and that the employer doesn't need to do anything. If that doesn't work, then someone is actively discriminating...

The 10 years ----are you talking about several years of study plus several years of working in US in H-1B visa ONLY or for any people who have legally stayed in US for 10 years??? I raise this question because I am curious to know whether I will fit this category. I was a foreign student in US for 10 years and pay foreign student tuition fee in full for 10 years. The first 6 years in several degrees and then back home and then come to US again for professional doctorate degree in 4 years. Originally I find employer to file me the H-1B visa but the quota for Master degree or above is full and then I back home until now. I am sure someone has similar situations to me!!
From other forum, someone said that it is extremely difficult to legalize the illegal aliens due to recent huge economic recession. But if each illegal aliens give non-refundable $5000 immigration entry fee to the country, the country will have about $60 billion fixed income. Then I immediately have thought about if our international students who have stayed in US for 5 years or above give more immigration entry fee to the country, the country will have tremendous cash flow into the economy and may help the economic crisis. I do not remember the predictions of last year but the fact is , last year it jumped from Jan 2005 (in Feb/March) to May 2006 (in September). That definitely is a BIG movement.
You are absolutely right. More precisely, last year with a grant of >19000 visas EB2 India PD jumped an impressive ~450 days. This year's available visa is not definitely known but is for sure >9000 and may be as much as ~36000. Just keep those numbers in memory. And we wait on...

Hi,
I have an approved I-140 (EB2 PD Jun-06) for a 'software engineering' related position. I recently moved to a 'product marketing' role within my company and was told that we would need to refile my PERM since this move constitutes a material change. Is this true?
1). Will I be able to retain my original PD of Jun-06 if we were to file for a 'marketing position'? Or would this be only possible if I needed to refile for a 'software engineering' or similar role?
2). Is there any way I can benefit from EB2 becoming current in July given that I have an approved engineering I-140 despite the fact that I have moved to marketing? (By the time I refile a new marketing PERM, I suspect retrogression will be back in effect)
3). My H1B was recently extended by 3 years (I complete 6 years in a few days) based on my 'engineering' approved I-140. They also filed an adjustment of my job duties to reflect my marketing role. I will visit Calgary, Canada next week (June) to renew my H1B stamp. Any chance that I might have problems during my interview since my 'engineering' I-140 is really not any more use since I moved to marketing? I'm just concerned that there might be problems since the 3 year extension is approved based on an 'engineering' I-140 and now I am no longer in an engineering role? Am I being paranoid :)

I have an approved I-140 (EB2 PD Jun-06) for a 'software engineering' related position. I recently moved to a 'product marketing' role within my company and was told that we would need to refile my PERM since this move constitutes a material change. Is this true?
1). Will I be able to retain my original PD of Jun-06 if we were to file for a 'marketing position'? Or would this be only possible if I needed to refile for a 'software engineering' or similar role?
2). Is there any way I can benefit from EB2 becoming current in July given that I have an approved engineering I-140 despite the fact that I have moved to marketing? (By the time I refile a new marketing PERM, I suspect retrogression will be back in effect)
3). My H1B was recently extended by 3 years (I complete 6 years in a few days) based on my 'engineering' approved I-140. They also filed an adjustment of my job duties to reflect my marketing role. I will visit Calgary, Canada next week (June) to renew my H1B stamp. Any chance that I might have problems during my interview since my 'engineering' I-140 is really not any more use since I moved to marketing? It is a oneway call for giving information on, "USCIS Receipting Delay - How Does This Affect You?" Perhaps they are going to repleat what they said on this on Oct 5 (i.e. mention nothing about applications not in the system, other than just to wait). What if USCIS guys mixed up "done" and "yet to be done" boxes. You will perhaps never find un-entered filings, unless someone checks manually each and every filing in each and every box.

I'm wondering if these figures actually provide ammo for people who claim that H1b is driving down salary. A $50k median starting and a $60k median is not that great.
